Toutes les transactions commerciales réalisées par la société MEDIACREA PRODUCTION sont soumises aux présentes Conditions Générales de Vente (ci-après les « Conditions Générales »). Elles définissent le cadre contractuel applicable entre tout utilisateur du site https://www.peralusa.com (ci-après le « Site ») souhaitant effectuer un achat en ligne (ci-après le « Client »), et la société SAS MEDIACREA PRODUCTION, dont le siège social est situé 24 rue des Archers, 91310 Montlhéry (France), immatriculée au Registre du Commerce et des Sociétés d’Évry sous le numéro 485 091 730 (ci-après « MEDIACREA PRODUCTION »).

MEDIACREA PRODUCTION se réserve le droit de modifier à tout moment certaines dispositions des présentes Conditions Générales.
La version applicable est celle en vigueur au moment de la commande, consultable sur le Site. Toute mise à jour prendra effet dès sa publication en ligne et s’appliquera à toute commande passée postérieurement à cette date.

La validation de la commande implique l’acceptation intégrale et sans réserve des présentes Conditions Générales. Le Client reconnaît, en validant sa commande, disposer de la capacité juridique requise pour contracter conformément aux articles 1123 et suivants du Code civil français.

Définitions
Pour une meilleure compréhension des présentes Conditions Générales:

- Territoire : désigne la France (y compris DOM-TOM), l’Espagne, le Portugal, la Belgique, la Suisse et le Luxembourg.
- Utilisateur ou Internaute : toute personne naviguant sur le Site depuis le Territoire, qu’elle effectue ou non un achat.
- Client : tout Utilisateur procédant à une commande sur le Site.

Les articles proposés à la vente par MEDIACREA PRODUCTION sur le site www.peralusa.com (ci-après les « Produits ») sont décrits et présentés avec le plus grand soin. Chaque Produit dispose d’une fiche individuelle précisant ses principales caractéristiques, sur la base des informations communiquées par nos fournisseurs, partenaires ou fabricants. Ces informations sont fournies à titre indicatif et peuvent être sujettes à de légères variations selon la fabrication artisanale ou les matières utilisées.

Les photographies et visuels présentés sur le Site ont pour but d’illustrer les Produits. Ils ne sont toutefois pas contractuels, les nuances de couleur ou de texture pouvant varier selon les écrans ou les séries de production.

MEDIACREA PRODUCTION se réserve le droit de proposer ponctuellement des offres promotionnelles (ci-après les « Promotions ») sur certains Produits. Ces offres peuvent concerner le prix, les conditions de livraison, les quantités disponibles ou toute autre caractéristique spécifique. Elles sont valables uniquement pendant la période indiquée et dans la limite des stocks disponibles.

Pour effectuer une commande sur le site www.peralusa.com et acheter un Produit, le Client doit :
- Renseigner ses coordonnées personnelles et de livraison conformément à la politique de confidentialité des données,
- Disposer d’un moyen de paiement valide (carte bancaire, virement SEPA, ou autre moyen proposé sur le Site).

Les commandes sont effectuées exclusivement en ligne, selon les étapes suivantes :
- Le Client ajoute les Produits souhaités à son panier ;
- Il saisit ses coordonnées de livraison ;
- Il prend connaissance des modes et frais de livraison disponibles ;
- Il sélectionne son mode de paiement ;
- Il accepte les Conditions Générales de Vente et valide sa commande ;
- Il est redirigé vers la plateforme sécurisée de paiement EUPAGO pour finaliser la transaction ;
- Enfin, il reçoit un e-mail de confirmation attestant la bonne prise en compte de sa commande.

Le Client est seul responsable de l’exactitude et de l’exhaustivité des informations fournies, notamment celles relatives à la livraison.

L’e-mail de confirmation envoyé par MEDIACREA PRODUCTION marque l’acceptation de la commande et constitue la formation du contrat de vente, conformément aux présentes Conditions Générales. Ce message récapitule les informations essentielles de la commande ainsi que la version applicable des Conditions Générales. Il appartient au Client de conserver cet e-mail, qui fait foi du contrat conclu.

MEDIACREA PRODUCTION ne saurait être tenu responsable si cet e-mail est filtré, supprimé ou classé en courrier indésirable. Les Conditions Générales demeurent accessibles à tout moment sur le Site.

Lors d’un achat standard d’un Produit appartenant à la collection PERALUSA, l’Internaute peut sélectionner et commander tout article figurant dans le catalogue permanent présenté sur le Site.

Toutefois, seule la confirmation de commande envoyée par MEDIACREA PRODUCTION atteste de la disponibilité effective du Produit.

En cas d’indisponibilité d’un Produit après validation de la commande, le Client sera informé dans les plus brefs délais, par e-mail ou par téléphone.
Selon le cas, il pourra être :
- informé de l’expédition partielle de sa commande,
- avisé d’un allongement du délai de livraison,
- ou notifié de l’annulation de la commande du Produit concerné, avec remboursement intégral des sommes versées pour cet article.

MEDIACREA PRODUCTION s’engage à maintenir une information produit aussi précise et actualisée que possible, mais ne saurait être tenue responsable des ruptures momentanées liées à la production artisanale ou à la disponibilité des matériaux.

Affichage des prix
Les prix des Produits proposés sur le site www.peralusa.com sont indiqués en euros (€), toutes taxes comprises (TTC), incluant la TVA en vigueur au moment de la commande.
Les prix peuvent varier lors d’offres ponctuelles ou de sessions promotionnelles spécifiques.

Prix à payer
Le montant total à régler correspond :
- au prix affiché sur la fiche Produit,
- augmenté des éventuels frais annexes (livraison, options de personnalisation, ou services complémentaires) clairement précisés lors du processus de commande.
Toute remise, bon d’achat ou code promotionnel applicable sera déduite avant la validation finale. Le prix définitif est confirmé uniquement au moment de la validation de la commande.

Codes promotionnels et bons d’achat
Le Client peut bénéficier de codes promotionnels ou bons d’achat émis par MEDIACREA PRODUCTION. Ces avantages sont strictement personnels, non cessibles et non cumulables, sauf mention contraire. Ils doivent être saisis dans le champ prévu à cet effet lors de la commande et sont valables uniquement pendant la période indiquée par la Société.

Frais de livraison
Les frais de port sont à la charge du Client. Leur montant dépend du mode de livraison, de la destination et des caractéristiques du colis.
Ces frais sont affichés dans le panier avant validation et soumis à l’approbation du Client.
Une estimation indicative peut être obtenue via la simulation d’achat sur le Site, mais seul le montant affiché lors de la validation de la commande fait foi. Des ajustements peuvent être appliqués pour les livraisons nécessitant un traitement spécifique (zones isolées, accès limité, etc.).

Escompte et TVA
Les paiements sont exigibles immédiatement lors de la commande, sans escompte possible. En cas de modification du taux de TVA, les prix seront ajustés automatiquement pour se conformer au taux légal en vigueur à la date de la commande.

Variations de prix
Les prix affichés sur le Site peuvent être modifiés à tout moment et sans préavis. En cas d’erreur manifeste d’affichage ou de tarification, MEDIACREA PRODUCTION se réserve le droit d’annuler la commande concernée après en avoir informé le Client. Les prix en vigueur au moment de la validation de la commande demeurent seuls applicables.

Paiement en devises étrangères
Les prix sont exprimés en euros (€). Si le Client effectue un paiement dans une autre devise, la conversion sera opérée selon le taux de change appliqué par sa banque au moment de la transaction. MEDIACREA PRODUCTION n’exerce aucun contrôle sur les éventuelles variations de ce taux.

MEDIACREA PRODUCTION advises its Clients to always use a secure network and take appropriate precautions to protect personal information online.

The shipment of items is limited to the Territory defined in these General Terms and Conditions. Delivery is carried out via a courier service or a specialized carrier, depending on the option selected by the Client at checkout, based on the weight, volume, and nature of the parcel. Each item may be shipped separately, depending on its availability.

Delivery Address and Information

When placing an order, the Client must provide accurate and complete delivery information, including full contact details and a valid phone number (landline or mobile). In the event of an error, omission, or incomplete address preventing successful delivery, MEDIACREA PRODUCTION and the carrier cannot be held liable for any delay, loss, or return of goods.

Carrier Delivery

For large or heavy items, delivery may be handled by a professional carrier. In such cases, the carrier will contact the Client directly by phone or email to arrange a delivery appointment (hereinafter the "Appointment"). The Client must inform the carrier of any access difficulties (narrow stairs, pedestrian area, no elevator, etc.), even if previously mentioned during the order process. It is also the Client's responsibility to verify that the access points (doors, corridors, elevators, etc.) allow for the delivery and placement of the ordered item. If delivery requires special equipment (such as a forklift or lifting device) due to access constraints reported by the Client, the Client must approve and cover the related costs prior to shipment.

The delivery times indicated at the time of order confirmation are expressed in business days and may vary depending on the Product. Due to differences in supply zones, artisanal production constraints, and logistical conditions, these times are provided for guidance only and may be subject to change.

MEDIACREA PRODUCTION makes every effort to meet the indicated timelines but cannot be held liable for any delays resulting from circumstances beyond its control, such as:

• Transport disruptions,
• Temporary stock shortages,
• Weather conditions, strikes, or other force majeure events.

The Client will be notified as soon as possible of any significant delay or change in the estimated shipping date.

If delivery cannot be completed on the agreed Appointment Date due to incorrect information, unreported access difficulties, or the Client's absence at the scheduled time, additional delivery fees may be charged by MEDIACREA PRODUCTION.

In such cases, MEDIACREA PRODUCTION will contact the Client to arrange payment of the additional fees before any new delivery attempt. If these fees are not settled, the Company reserves the right to withhold delivery of the Product.

Any damage, deterioration, or loss resulting from such logistical issues shall be entirely borne by the Client.

If the Client wishes to change the delivery address or postpone the delivery date, they must notify MEDIACREA PRODUCTION as soon as possible and no later than three (3) business days before the initially scheduled delivery date.

Requests must be submitted via the Website "Contact" section and include:

• the order number,
• the Product(s) concerned,
• the requested change (new address and/or new date) and a brief reason.

MEDIACREA PRODUCTION will confirm by email or phone whether the request is accepted or refused as soon as possible, and will indicate any impact on the delivery timeline.

Note: depending on logistics progress, some requests may not be feasible. Rescheduling is subject to carrier availability.

Upon delivery, it is essential that the Client unpacks the Product in the presence of the courier or carrier and verifies:

• that the Product matches the order, and
• that it is not damaged, before signing the delivery slip.

Claims and Reservations

In case of any irregularity, the Client must make specific and detailed reservations on the delivery slip.

These reservations must be:

• handwritten,
• dated and signed,
• and must clearly describe the issue.

Generic comments such as "damaged product" or "subject to inspection" are not acceptable.

The Client must specify the exact nature of the defect (e.g., scratches, stains, dents, incorrect color or model, etc.).

In the event of a delivery error or damaged Product, the Client must refuse the parcel and report the issue immediately via the "Contact" section of the Website or by email at info@peralusa.com, within five (5) business days following delivery.

The Client must also confirm the claim by registered mail with acknowledgment of receipt sent to:

Acceptance of Delivery

No claim will be accepted after this period.

If the Client signs the delivery slip without reservation, the Product is deemed compliant and accepted, and no subsequent complaint will be admissible — even if the package was not opened in the presence of the courier.

Except in cases of non-conformity or hidden defect, any claim made without following the above procedure will be considered invalid.

Order Cancellation

The Client may cancel any order before it has been shipped, without providing a reason. To do so, the Client must contact PERALUSA / MEDIACREA PRODUCTION by email via the "Contact" section of the website. An email confirmation will be sent once the cancellation has been validated by our team.

Right of Withdrawal

In accordance with European Directive 2011/83/EU, the Client has a legal period of 14 calendar days from the date of receipt of the Product to exercise their right of withdrawal, without justification and without penalty, except for return shipping costs, which remain the Client's responsibility.

Applicable national withdrawal periods:

• Belgium: 15 days (Belgian law)
• Portugal: 14 days (Portuguese law)

Exceptions

The right of withdrawal does not apply to personalized or made-to-order Products, such as poufs customized with specific colors, stitching, embroidery, or logos, pursuant to Article L221-28 of the French Consumer Code.

Procedure and Return Conditions

The Client may submit a withdrawal request through the website's "Contact" section or by email to info@peralusa.com. The Product must be returned at the Client's expense, using a carrier or postal service of their choice, to the address provided by PERALUSA / MEDIACREA PRODUCTION upon approval of the return.

Returned items must be:

• in perfect condition,
• unused,
• in their original packaging,
• and accompanied by all accessories and documentation.

Upon receipt, each Product will undergo a quality inspection. If the return conditions are met, reimbursement of the Product price (excluding return costs) will be processed within a maximum of 30 days from receipt of the parcel.

If wear, damage, or use is observed, the refund amount may be adjusted to reflect the depreciation in value of the Product.

MEDIACREA PRODUCTION provides the Client with a legal warranty against hidden defects that may affect the Products sold, in accordance with the provisions of French law (Articles 1641 et seq. of the Civil Code), unless otherwise specified on the Website.

This warranty applies only if the Client can prove that the defect existed prior to delivery of the Product by MEDIACREA PRODUCTION.

The Client is responsible for having the Product examined at their own expense in order to obtain proof of the hidden defect.

The liability of MEDIACREA PRODUCTION shall in all cases be limited to the value of the affected Product.

No additional compensation may be claimed by the Client beyond what is expressly provided for under the French Consumer Code.

The PERALUSA brand is a registered and protected trademark with the INPI (French National Institute of Industrial Property), as is the domain name www.peralusa.com.

These elements are the exclusive property of SAS MEDIACREA PRODUCTION and may not be used, reproduced, or imitated without prior written consent.

It is strictly forbidden to create hyperlinks redirecting to or from other websites without the explicit authorization of MEDIACREA PRODUCTION.

All graphic, visual, and editorial content displayed on the Website — including photographs, videos, drawings, product descriptions, logos, and layouts — are protected by copyright law and, where applicable, by related rights belonging to their respective owners.

Any additional costs related to reshipment, storage, or a new delivery attempt shall be borne entirely by the Client.

The liability of MEDIACREA PRODUCTION is, in any case, strictly limited to the amount paid or payable by the Client for the order concerned, regardless of the cause or form of action.

Force majeure events, as defined under French law — including but not limited to strikes, labor disputes, riots, wars, pandemics, natural disasters, or major logistical disruptions — shall be considered grounds for exemption from liability.

The selection and purchase of Products are the sole responsibility of the Client.

The inability to use a Product, for example due to incompatibility or improper use, shall not give rise to compensation, refund, or liability, except in cases of:

• proven hidden defect,
• non-conformity,
• product defect, or
• valid exercise of the right of withdrawal in accordance with the French Consumer Code.

These General Terms and Conditions of Sale are governed by and construed in accordance with French law.

Before taking any legal action, both parties agree to seek an amicable resolution to any dispute relating to the formation, interpretation, or performance of the order.

This amicable process does not suspend or interrupt the statutory limitation periods applicable to warranty claims.

If no amicable agreement can be reached, any dispute or claim arising from the sale, including in the event of multiple defendants or a warranty claim, shall fall under the exclusive jurisdiction of the courts within the jurisdiction of MEDIACREA PRODUCTION's registered office.

If the buyer is a consumer (non-professional), the competent court shall be determined in accordance with the provisions of the French Code of Civil Procedure and the Consumer Code, allowing the consumer to bring proceedings before the court of their place of residence.

The General Terms and Conditions of Sale, all orders, email correspondence, and the sales contract concluded between the Client and MEDIACREA PRODUCTION shall be written in French for all territories covered by the Website.

In the event of a translation into another language, the French version shall prevail in the case of any discrepancy in interpretation or dispute.

If one or more provisions of these General Terms and Conditions of Sale are deemed null, invalid, unenforceable, void, illegal, or inapplicable pursuant to any law, regulation, or final ruling by a competent court, such a finding shall not affect the validity, legality, or enforceability of the remaining provisions.

The User or Client shall remain bound by their contractual obligations, and the modification or removal of the affected clause shall not alter the overall balance or validity of the contract, whose remaining provisions shall continue to apply in full force.
