Todas las transacciones comerciales realizadas por MEDIACREA PRODUCTION están sujetas a las presentes Condiciones Generales de Venta (en adelante, las “Condiciones”). Estas definen el marco contractual entre cualquier usuario del sitio web https://www.peralusa.com (en adelante, el “Sitio”) que desee realizar una compra en línea (en adelante, el “Cliente”) y SAS MEDIACREA PRODUCTION, cuya sede social se encuentra en 24 rue des Archers, 91310 Montlhéry, Francia, inscrita en el Registro Mercantil de Evry con el número 485 091 730 (en adelante, “MEDIACREA PRODUCTION”).

MEDIACREA PRODUCTION se reserva el derecho de modificar o actualizar estas Condiciones en cualquier momento. La versión aplicable será la vigente en el momento del pedido, disponible en el Sitio.
Cualquier modificación surtirá efecto desde su publicación en línea y se aplicará a los pedidos posteriores.

Al validar un pedido, el Cliente acepta plena e incondicionalmente las presentes Condiciones. El Cliente confirma poseer la capacidad legal necesaria para contratar conforme a los artículos 1123 y siguientes del Código Civil francés.

Definiciones

Para facilitar la comprensión de las presentes Condiciones:

Territorio: hace referencia a Francia (incluidos los territorios de ultramar), España, Portugal, Bélgica, Suiza y Luxemburgo.
Usuario o Visitante: cualquier persona que acceda al Sitio desde el Territorio, realice o no una compra.
Cliente: cualquier Usuario que efectúe un pedido a través del Sitio.

Los artículos ofrecidos a la venta por MEDIACREA PRODUCTION en el sitio web www.peralusa.com (en adelante, los “Productos”) se describen y presentan con el máximo cuidado.
Cada Producto cuenta con una ficha informativa individual que detalla sus características principales, basadas en datos proporcionados por nuestros proveedores, socios o fabricantes. Esta información se ofrece a título indicativo y puede variar ligeramente debido a la producción artesanal o a diferencias en los materiales.

Las fotografías y elementos visuales mostrados en el Sitio tienen una finalidad ilustrativa. No obstante, carecen de valor contractual, ya que los tonos de color y las texturas pueden variar según la configuración de la pantalla o los distintos lotes de producción.

MEDIACREA PRODUCTION podrá ofrecer ocasionalmente campañas promocionales (en adelante, las “Promociones”) sobre determinados Productos. Estas ofertas pueden referirse al precio, condiciones de entrega, cantidades u otras características específicas.
Las Promociones son válidas únicamente durante el período indicado y dentro del límite de las existencias disponibles.

Para realizar un pedido en el sitio web www.peralusa.com y adquirir un Producto, el Cliente debe:

  • Proporcionar información personal y de entrega exacta, de acuerdo con la política de privacidad.
  • Disponer de un método de pago válido (tarjeta de crédito/débito, transferencia SEPA u otro método ofrecido en el Sitio).

Los pedidos se realizan exclusivamente en línea, siguiendo los pasos que se detallan a continuación:

  1. El Cliente añade los Productos deseados a su cesta de compra.
  2. Introduce sus datos de entrega.
  3. Revisa las opciones de envío disponibles y las tarifas asociadas.
  4. Selecciona el método de pago.
  5. Acepta las Condiciones Generales y confirma el pedido.
  6. Es redirigido a la plataforma de pago segura EUPAGO para completar la transacción.
  7. Recibe un correo electrónico de confirmación, que acusa recibo del pedido y valida la compra.

El Cliente es el único responsable de garantizar la exactitud y la integridad de la información proporcionada, en particular la dirección de entrega.

El correo electrónico de confirmación enviado por MEDIACREA PRODUCTION constituye la aceptación del pedido y formaliza el contrato de venta conforme a estas Condiciones.
Dicho correo resume los detalles del pedido e incluye la versión aplicable de las Condiciones Generales. Se recomienda al Cliente conservarlo como prueba del acuerdo.

MEDIACREA PRODUCTION no podrá ser considerada responsable en caso de pérdida o clasificación errónea de este correo por filtros antispam u otros sistemas similares.
Las Condiciones Generales permanecen accesibles en todo momento en el Sitio.

Cuando el Cliente adquiere un Producto estándar de la colección PERALUSA, puede seleccionar y pedir cualquier artículo disponible en el catálogo permanente mostrado en el Sitio.

No obstante, únicamente la confirmación de pedido enviada por MEDIACREA PRODUCTION constituye la prueba de la disponibilidad real del Producto.

Si un Producto resulta indisponible después de la validación del pedido, el Cliente será informado lo antes posible, ya sea por correo electrónico o por teléfono. Según el caso, el Cliente podrá:

  • ser notificado de un envío parcial,
  • ser informado de una prórroga del plazo de entrega,
  • o ser avisado de la cancelación del artículo indisponible, en cuyo caso se procederá al reembolso íntegro del Producto afectado.

MEDIACREA PRODUCTION se esfuerza por mantener la información de los Productos precisa y actualizada, pero no puede ser considerada responsable de rupturas de stock temporales relacionadas con la producción artesanal o la disponibilidad de materiales.

Visualización de precios

Los precios de los Productos ofrecidos en www.peralusa.com se muestran en euros (€) e incluyen todos los impuestos aplicables (IVA) en el momento del pedido.
Los precios pueden variar durante ofertas especiales o campañas promocionales.

Importe total a pagar

El importe total corresponde a:

  • el precio indicado en la ficha del Producto, y
  • cualquier cargo adicional (envío, personalización o servicios opcionales) claramente especificado durante el proceso de compra.

Los descuentos, vales o códigos promocionales aplicables se deducirán antes de la confirmación final.
El precio definitivo solo queda fijado cuando el pedido es validado.

Códigos promocionales y vales

El Cliente puede utilizar códigos promocionales o vales emitidos por MEDIACREA PRODUCTION.
Son personales, intransferibles y no acumulables salvo indicación contraria.
Deben introducirse durante el pago y solo son válidos dentro del período especificado por la Empresa.

Gastos de envío

Los gastos de envío corren a cargo del Cliente.
Su importe depende del método de entrega, destino y características del paquete.
Estos costes se muestran en la cesta antes de la validación del pedido y deben ser aprobados por el Cliente.

Un cálculo estimado puede obtenerse mediante simulación de compra, pero únicamente el importe mostrado en el proceso de pago es vinculante.
Pueden aplicarse cargos adicionales para entregas que requieran manipulación especial (zonas remotas, accesos restringidos, etc.).

Descuentos e IVA

El pago de los pedidos es exigible de forma inmediata al confirmar la compra, sin posibilidad de descuento.
En caso de modificación del tipo de IVA, los precios se ajustarán automáticamente conforme al nuevo tipo legal.

Variación de precios

Los precios mostrados en el Sitio pueden modificarse en cualquier momento sin previo aviso.
En caso de un error evidente de precio o de visualización, MEDIACREA PRODUCTION se reserva el derecho de cancelar el pedido afectado tras informar al Cliente.
Los precios vigentes en el momento de la validación del pedido prevalecerán.

Pagos en moneda extranjera

Todos los precios están expresados en euros (€).
Si el pago se realiza en otra moneda, la conversión se efectuará según el tipo de cambio aplicado por el banco del Cliente en el momento de la transacción.
MEDIACREA PRODUCTION no tiene control sobre posibles variaciones de tipo de cambio.

MEDIACREA PRODUCTION advises its Clients to always use a secure network and take appropriate precautions to protect personal information online.

The shipment of items is limited to the Territory defined in these General Terms and Conditions. Delivery is carried out via a courier service or a specialized carrier, depending on the option selected by the Client at checkout, based on the weight, volume, and nature of the parcel. Each item may be shipped separately, depending on its availability.

Delivery Address and Information

When placing an order, the Client must provide accurate and complete delivery information, including full contact details and a valid phone number (landline or mobile). In the event of an error, omission, or incomplete address preventing successful delivery, MEDIACREA PRODUCTION and the carrier cannot be held liable for any delay, loss, or return of goods.

Carrier Delivery

For large or heavy items, delivery may be handled by a professional carrier. In such cases, the carrier will contact the Client directly by phone or email to arrange a delivery appointment (hereinafter the "Appointment"). The Client must inform the carrier of any access difficulties (narrow stairs, pedestrian area, no elevator, etc.), even if previously mentioned during the order process. It is also the Client's responsibility to verify that the access points (doors, corridors, elevators, etc.) allow for the delivery and placement of the ordered item. If delivery requires special equipment (such as a forklift or lifting device) due to access constraints reported by the Client, the Client must approve and cover the related costs prior to shipment.

The delivery times indicated at the time of order confirmation are expressed in business days and may vary depending on the Product. Due to differences in supply zones, artisanal production constraints, and logistical conditions, these times are provided for guidance only and may be subject to change.

MEDIACREA PRODUCTION makes every effort to meet the indicated timelines but cannot be held liable for any delays resulting from circumstances beyond its control, such as:

  • Transport disruptions,
  • Temporary stock shortages,
  • Weather conditions, strikes, or other force majeure events.

The Client will be notified as soon as possible of any significant delay or change in the estimated shipping date.

If delivery cannot be completed on the agreed Appointment Date due to incorrect information, unreported access difficulties, or the Client's absence at the scheduled time, additional delivery fees may be charged by MEDIACREA PRODUCTION.

In such cases, MEDIACREA PRODUCTION will contact the Client to arrange payment of the additional fees before any new delivery attempt. If these fees are not settled, the Company reserves the right to withhold delivery of the Product.

Any damage, deterioration, or loss resulting from such logistical issues shall be entirely borne by the Client.

If the Client wishes to change the delivery address or postpone the delivery date, they must notify MEDIACREA PRODUCTION as soon as possible and no later than three (3) business days before the initially scheduled delivery date.

Requests must be submitted via the Website "Contact" section and include:

  • the order number,
  • the Product(s) concerned,
  • the requested change (new address and/or new date) and a brief reason.

MEDIACREA PRODUCTION will confirm by email or phone whether the request is accepted or refused as soon as possible, and will indicate any impact on the delivery timeline.

Note: depending on logistics progress, some requests may not be feasible. Rescheduling is subject to carrier availability.

Upon delivery, it is essential that the Client unpacks the Product in the presence of the courier or carrier and verifies:

  • that the Product matches the order, and
  • that it is not damaged, before signing the delivery slip.

Claims and Reservations

In case of any irregularity, the Client must make specific and detailed reservations on the delivery slip.

These reservations must be:

  • handwritten,
  • dated and signed,
  • and must clearly describe the issue.

Generic comments such as "damaged product" or "subject to inspection" are not acceptable.

The Client must specify the exact nature of the defect (e.g., scratches, stains, dents, incorrect color or model, etc.).

In the event of a delivery error or damaged Product, the Client must refuse the parcel and report the issue immediately via the "Contact" section of the Website or by email at info@peralusa.com, within five (5) business days following delivery.

The Client must also confirm the claim by registered mail with acknowledgment of receipt sent to:

Acceptance of Delivery

No claim will be accepted after this period.

If the Client signs the delivery slip without reservation, the Product is deemed compliant and accepted, and no subsequent complaint will be admissible — even if the package was not opened in the presence of the courier.

Except in cases of non-conformity or hidden defect, any claim made without following the above procedure will be considered invalid.

Order Cancellation

The Client may cancel any order before it has been shipped, without providing a reason. To do so, the Client must contact PERALUSA / MEDIACREA PRODUCTION by email via the "Contact" section of the website. An email confirmation will be sent once the cancellation has been validated by our team.

Right of Withdrawal

In accordance with European Directive 2011/83/EU, the Client has a legal period of 14 calendar days from the date of receipt of the Product to exercise their right of withdrawal, without justification and without penalty, except for return shipping costs, which remain the Client's responsibility.

Applicable national withdrawal periods:

  • Belgium: 15 days (Belgian law)
  • Portugal: 14 days (Portuguese law)

Exceptions

The right of withdrawal does not apply to personalized or made-to-order Products, such as poufs customized with specific colors, stitching, embroidery, or logos, pursuant to Article L221-28 of the French Consumer Code.

Procedure and Return Conditions

The Client may submit a withdrawal request through the website's "Contact" section or by email to info@peralusa.com. The Product must be returned at the Client's expense, using a carrier or postal service of their choice, to the address provided by PERALUSA / MEDIACREA PRODUCTION upon approval of the return.

Returned items must be:

  • in perfect condition,
  • unused,
  • in their original packaging,
  • and accompanied by all accessories and documentation.

Upon receipt, each Product will undergo a quality inspection. If the return conditions are met, reimbursement of the Product price (excluding return costs) will be processed within a maximum of 30 days from receipt of the parcel.

If wear, damage, or use is observed, the refund amount may be adjusted to reflect the depreciation in value of the Product.

MEDIACREA PRODUCTION provides the Client with a legal warranty against hidden defects that may affect the Products sold, in accordance with the provisions of French law (Articles 1641 et seq. of the Civil Code), unless otherwise specified on the Website.

This warranty applies only if the Client can prove that the defect existed prior to delivery of the Product by MEDIACREA PRODUCTION.

The Client is responsible for having the Product examined at their own expense in order to obtain proof of the hidden defect.

The liability of MEDIACREA PRODUCTION shall in all cases be limited to the value of the affected Product.

No additional compensation may be claimed by the Client beyond what is expressly provided for under the French Consumer Code.

The PERALUSA brand is a registered and protected trademark with the INPI (French National Institute of Industrial Property), as is the domain name www.peralusa.com.

These elements are the exclusive property of SAS MEDIACREA PRODUCTION and may not be used, reproduced, or imitated without prior written consent.

It is strictly forbidden to create hyperlinks redirecting to or from other websites without the explicit authorization of MEDIACREA PRODUCTION.

All graphic, visual, and editorial content displayed on the Website — including photographs, videos, drawings, product descriptions, logos, and layouts — are protected by copyright law and, where applicable, by related rights belonging to their respective owners.

Any additional costs related to reshipment, storage, or a new delivery attempt shall be borne entirely by the Client.

The liability of MEDIACREA PRODUCTION is, in any case, strictly limited to the amount paid or payable by the Client for the order concerned, regardless of the cause or form of action.

Force majeure events, as defined under French law — including but not limited to strikes, labor disputes, riots, wars, pandemics, natural disasters, or major logistical disruptions — shall be considered grounds for exemption from liability.

The selection and purchase of Products are the sole responsibility of the Client.

The inability to use a Product, for example due to incompatibility or improper use, shall not give rise to compensation, refund, or liability, except in cases of:

  • proven hidden defect,
  • non-conformity,
  • product defect, or
  • valid exercise of the right of withdrawal in accordance with the French Consumer Code.

These General Terms and Conditions of Sale are governed by and construed in accordance with French law.

Before taking any legal action, both parties agree to seek an amicable resolution to any dispute relating to the formation, interpretation, or performance of the order.

This amicable process does not suspend or interrupt the statutory limitation periods applicable to warranty claims.

If no amicable agreement can be reached, any dispute or claim arising from the sale, including in the event of multiple defendants or a warranty claim, shall fall under the exclusive jurisdiction of the courts within the jurisdiction of MEDIACREA PRODUCTION's registered office.

If the buyer is a consumer (non-professional), the competent court shall be determined in accordance with the provisions of the French Code of Civil Procedure and the Consumer Code, allowing the consumer to bring proceedings before the court of their place of residence.

The General Terms and Conditions of Sale, all orders, email correspondence, and the sales contract concluded between the Client and MEDIACREA PRODUCTION shall be written in French for all territories covered by the Website.

In the event of a translation into another language, the French version shall prevail in the case of any discrepancy in interpretation or dispute.

If one or more provisions of these General Terms and Conditions of Sale are deemed null, invalid, unenforceable, void, illegal, or inapplicable pursuant to any law, regulation, or final ruling by a competent court, such a finding shall not affect the validity, legality, or enforceability of the remaining provisions.

The User or Client shall remain bound by their contractual obligations, and the modification or removal of the affected clause shall not alter the overall balance or validity of the contract, whose remaining provisions shall continue to apply in full force.
